La Presidenta de México, Claudia Sheinbaum Pardo, informó que enviará al Congreso de la Unión la propuesta para cambiar la fecha de la elección del Poder Judicial, del 2027 al domingo 4 de junio de 2028 a nivel federal y local, además de modificaciones a la boleta para simplificar y permitir la participación de las mexicanas y los mexicanos.
“Esta es la propuesta que estamos haciendo, como ven, es mover la elección del Poder Judicial del 2027 al 2028, en caso de que haya revocación de mandato en el 2028 se hace el mismo día y en la misma casilla. Y hay algunas modificaciones que se hacen para facilitar la boleta por las características que tuvo la votación del 2025 de tal manera que sea más sencillo para las y los electores para quien votamos, para quienes vamos a elegir que sea más sencilla la votación, pueda distinguirse quien propone a los candidatos.
“Y también la elección en las tres comisiones del Poder Ejecutivo, Legislativo y Judicial que pueden tener una Comisión Única que pueda hacer la evaluación de las calificaciones de cada uno para poder simplificar y permitir la participación de todas y todos los mexicanos en la elección del Poder Judicial”, puntualizó en la conferencia matutina: “Las mañaneras del pueblo”.
La Jefa del Ejecutivo Federal explicó que el cambio de fecha propuesta permitirá que las y los electores no cambien de casilla para realizar su voto, como ocurriría si la votación se lleva a cabo en 2027. “Si fuera en este momento, en el 2027, la elección, tendrían que ser casillas distintas, entonces la gente tendría que ir a votar por gobernador, presidentes municipales, diputados, en una casilla y luego moverse a otra casilla para votar por el Poder Judicial”, informó.
La consejera jurídica del Ejecutivo Federal, Luisa María Alcalde Luján, detalló que con el cambio de fecha las elecciones posteriores seguirán siendo concurrentes con los procesos ordinarios del 2030, 2033 y 2036 para renovar las vacantes que vayan generando.
Señaló que en el 2028 se elegirán: 4 magistrados electorales de Sala Superior del Tribunal Electoral del Poder Judicial de la Federación (TEPJF); 463 magistrados de Tribunales Colegiados de Circuito; 385 jueces de Distrito y en los Poderes Judiciales locales: 424 magistrados y 2 mil 831 jueces de 25 entidades federativas.
Informó que además se propone la creación de la Comisión Coordinadora para homologar metodologías y criterios de evaluación de los Comités de Evaluación de los tres Poderes, que cada uno elija a una coordinadora o coordinador, verificarán el cumplimiento de requisitos formales de todos los aspirantes.
Además, se propone la reducción del número de candidatos para facilitar la elección: la Comisión Coordinadora seleccionará a las cuatro personas mejor evaluadas, se realiza una insaculación pública para reducir a dos candidatos por cargo, observando la paridad de género.
Agregó que también se simplifica la boleta electoral: cada elector votará por un juez y un magistrado para cada una de las especialidades, entre las candidaturas que envíe cada Poder; se distinguirán las candidaturas que postule cada Poder con claridad incluyendo a magistrados y jueces en funciones que quisieran reelegirse, para ello, el INE dividirá el territorio en los distritos judiciales que sean necesarios para garantizar este derecho.
Se capacitará de forma permanente y obligatoria a todos los jueces y magistrados, para ello, el Tribunal de Disciplina, en coordinación con la Escuela Judicial, implementará programas de actualización y capacitación. La ley detallará los criterios, metodologías, plazos y demás reglas aplicables a estas evaluaciones para garantizar procesos transparentes.
En los poderes judiciales locales se refuerzan criterios para que las elecciones judiciales de los estados repliquen las reglas del federal, incluyendo sus bases, etapas, procedimientos, términos, plazos, modalidades, requisitos, duración de cargos, y de manera enunciativa, se especifican que deberán tener: Comités de Evaluación con criterios y metodologías unificadas; insaculación obligatoria de candidaturas; reducción de candidaturas en las boletas.; evaluación del desempeño durante el primer año y capacitación permanente por el Tribunal de Disciplina local.
Puntualizó que, como modificaciones adicionales, se propondrá:
- Las elecciones judiciales y las ordinarias podrán hacerse en la misma ubicación, garantizando que los representantes de partidos no intervengan.
- El escrutinio y cómputo de votos se hará en las mismas casillas donde fueron sufragados.
- Se adelanta 3 meses el plazo del Senado para emitir la convocatoria general, de septiembre a abril del año anterior a la elección, para que los Comités tengan tiempo suficiente de evaluar candidaturas.
- Cuando los jueces y magistrados se ausenten por muerte, renuncia o destitución, el cargo quedará vacante para renovarse en la próxima elección para un nuevo periodo (actualmente lo ocupa el segundo lugar).
- Se crean 2 secciones en la SCJN que desahogarán asuntos menores para que el Pleno pueda eficientar sus trabajos
- La elección de 2028 podrá ser concurrente con la revocación de mandato, de solicitarse conforme al artículo 35 constitucional.
